These Terms and Conditions (the “Terms”) govern your access to and use of the Banksy Explained website and any related features and services (together, the “Website”). Please read them carefully. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Introduction and Legal Operator

Banksy Explained is an independent editorial, educational, research and market intelligence platform operated under the registered fictitious name “Banksy Explained.” The platform was founded by Sebastien J Laboureau and is editorially directed, run and maintained by him.

For legal, administrative and operational purposes, the Website is operated by Markowicz Fine Art LLC, a Florida limited liability company, doing business as Banksy Explained (“Banksy Explained”, “we”, “us” or “our”).

Banksy Explained is unofficial and unauthorized. It is not affiliated with, endorsed by, sponsored by, approved by, or officially connected to Banksy, Pest Control Office Ltd., Gross Domestic Product, or any related rights holder.

2. Editorial Independence

The editorial content, research, commentary, analysis and opinions published on Banksy Explained are developed under the editorial direction of Sebastien J Laboureau. Markowicz Fine Art LLC does not dictate the editorial opinions, research conclusions or critical commentary of the platform, but may intervene where reasonably necessary for legal, intellectual property, authentication, privacy, technical, operational, regulatory or reputational risk management.

3. Permitted Use

The Website is provided for personal, educational, research and informational use.

You may read the Website, quote short extracts with appropriate attribution, and share links to public pages, in each case for lawful purposes, provided that you do not:

  • copy or reproduce substantial portions of the Website or of any individual page;
  • misrepresent any affiliation with, or endorsement by, Banksy Explained; or
  • use the content commercially without our prior written authorization.

    You agree not to use the Website:

  • to copy catalogue entries at scale, or to reconstitute all or a substantial part of the catalogue elsewhere;
  • to mislead any person as to any affiliation with Banksy, Pest Control Office Ltd., Gross Domestic Product or any related rights holder;
  • to authenticate, certify or verify the authorship of any artwork; or
  • to interfere with the security, hosting, availability, measurement or forms of the Website, or to attempt to gain unauthorized access to any part of it.
  • 5. Intellectual Property

    Banksy Explained owns or controls the original text, structure, selection, arrangement and compilation of the Website, together with its research, commentary, analysis, layout, design and other original materials.

    Third party images, artwork titles, trademarks, photographs, logos and other third party materials remain the property of their respective rights holders. Nothing on the Website transfers any right in those materials to you.

    We do not claim ownership of Banksy artworks, Banksy imagery, Pest Control Office marks, Gross Domestic Product marks or third party photographs.

    6. Fair Use and Third Party Rights

    Certain third party materials may be referenced or displayed for purposes such as education, research, criticism, commentary, news reporting, historical documentation or market analysis. Banksy Explained does not claim ownership of such third party materials. If you believe that material appearing on the Website infringes your rights, please contact us so that we may review the matter promptly.

    7. No Authentication, Legal, Financial or Investment Advice

    Banksy Explained does not authenticate artworks. Nothing on the Website constitutes an authentication, a certificate of authenticity, a verification of provenance or a guarantee of authorship.

    Where applicable, only Pest Control Office Ltd. or other appropriate rights holders may issue official authentication.

    Market reports, auction results, estimates and related commentary are provided for information only. Art market values fluctuate, and past results are not indicative of future outcomes.

    No content on the Website constitutes legal, tax, financial, investment or authentication advice. You should obtain independent professional advice before buying, selling, insuring, valuing or otherwise relying on any market information published here.

    8. Services and Commercial Separation

    Banksy Explained may provide general information about research, advisory, appraisal related, market intelligence or collector services. Any commercial service, appraisal related service, advisory engagement, sale, consignment or transaction is separate from the editorial content of the Website and, where applicable, is handled through the relevant legal operator or service provider.

    Banksy Explained is not an official sales channel for Banksy artworks. Editorial and catalogue pages should not be interpreted as offers to buy or sell any specific artwork.

    9. External Links

    The Website may contain links to third party websites and resources. Such links are provided for convenience and reference only. They do not imply endorsement, sponsorship or affiliation, and we accept no responsibility for the content, accuracy, availability or practices of any third party site.

    10. User Submissions

    The Website may offer contact forms or other means of sending us information. Where you submit material to us:

  • you represent that you hold the necessary rights in what you submit, and that its submission does not infringe the rights of any third party;
  • you grant us permission to review your submission and to respond to it;
  • you should not send confidential or privileged information unless a separate written relationship has been agreed in advance; and
  • we may decline, ignore, retain or delete any submission at our discretion, and we are under no obligation to reply, to publish, or to treat any submission as confidential.

    You may subscribe to our newsletter voluntarily. Every newsletter includes an unsubscribe link, and you may withdraw at any time. We send commercial email in accordance with applicable law.

    Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

    We may update these Terms from time to time. Revised Terms take effect when posted on this page, and the “Last updated” date shown above will be amended accordingly. Your continued use of the Website after any change constitutes acceptance of the revised Terms.

    14. Governing Law

    These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
